Failure to honor contract gets contractor jail time

Duwan R. Mundin, of Chesterfield, was found guilty on Tuesday, Oct. 1 in Louisa County General District Court for three misdemeanor counts of unlawful acts per business regulations.

In June 2012, Mundin was hired by Louisa resident Robin Rucker to tear down her rotting deck, do a complete yard makeover and build a porch and patio.

Rucker, who paid Mundin more than $30,000, said he did not complete any of the work agreed to in the written contract between the two.

The court sentenced Mundin to 36 months with all but 18 months suspended and two years of unsupervised probation.

Rucker said she is continuing her suit against Mundin for damages and added that the Commonwealth was to file a construction fraud charge on Mundin as well.

The Louisa Commonwealth’s Attorney’s office was contacted to verify the fraud charge, but would not comment on the matter.
